Jakarta: The Improvement of Intellectual Property Index in Indonesia

The US Chamber of Commerce has made the perspective that Indonesia has improved its Intellectual Property ("IP") index significantly over the years. This progress can be attributed to various government policies, regulations, and initiatives aimed at strengthening the country's IP laws and protection mechanisms. According to the US Chamber of Commerce Global Innovation Policy Center ("GIPC")’s annual report in 2023, Indonesia ranked 50th out of 55 countries surveyed.

The Indonesian ranking position in 2023 has improved itself 1 level compared to the previous year with a score of 30.42% out of 100. This marks an improvement from Indonesia’s rank of 51 out of 55 countries in the 2022 report. In addition, the ranking position in several countries like the ASEAN Region also increase since they are improving their IP index. The GIPC has commended Indonesia's commitment to strengthen its IP system and promote innovation and creativity in the country. The GIPC recognizes that there is still room for improvement, but Indonesia's progress in this area is a positive sign for the country's future growth and development.

However if Indonesia is compared with several countries in the ASEAN Region, Indonesia has the lowest score and rank position. The US Chamber of Commerce has provided recommendations to Indonesia for further improvement in its IP index ranking and score. One of the key recommendations is for Indonesia to continue improving its policy and legal framework for IP protection. This includes developing and implementing clear and effective laws and regulations that provide strong IP protection, particularly for emerging technologies such as digital piracy and biotechnology. Another recommendation for Indonesia is changing the legal protection period for the design industry which has lasted for almost 23 years. By changing its legal protection period from 10 years to 15 years will become an indicator of improvement for Indonesia in the score and rank position based on the US Chamber of Commerce perspective.

The IP International Index is a ranking system created by the GIPC to evaluate the strength and effectiveness of countries' IP laws and protection mechanisms. Each year, the GIPC releases an updated report on the IP International Index, evaluating the IP systems of 55 countries. According to the 11th annual report edition in 2023, the score and ranking position for US is in the 1st at 95.48%, followed by UK in 2nd at 94.14%, and France in 3rd at 93.2%. In the Asian Region, the best comprehensive legal and regulatory framework for IP protection is held by Japan ranked 10th at 91.26%, followed by Singapore 11th at 84.94%, and South Korea 12th at 84.44%. Meanwhile, in the ASEAN Region, the best system and protection of IP rights is held by Singapore with a score of 84.94%, Malaysia at 53.44%, Philippines at 41.58%, Brunei Darussalam at 41.08%, Vietnam at 40.74% and Thailand at 38.23%. (JP/SAS-su)
